Welcome to Mero Taxi. These Terms and Conditions ("Terms") govern your access and use of the Mero Taxi mobile application (for passengers) and the Mero Taxi Partner mobile application (for drivers), both operated by Obeevend Online ("Company", "we", "us", or "our").
By downloading, installing, or using our applications, you agree to be bound by these Terms. If you do not agree, please do not use the apps.
PART A: MERO TAXI (Passenger Terms)
1. Account Registration
Eligibility: You must be at least 18 years old and legally competent to enter into a contract under the Indian Contract Act, 1872.
Accuracy: You agree to provide accurate, current, and complete information (including a valid Indian mobile number) during registration.
Security: You are responsible for maintaining the confidentiality of your account credentials and OTPs, and for all activities that occur under your account.
2. Services Provided
Mero Taxi acts as an aggregator providing an online technology platform that connects passengers with independent third-party transportation providers (Drivers).
Obeevend Online does not provide transportation services. We are not a taxi operator, common carrier, or public transport provider.
3. Fares, Fees, and Payment
Pricing: Fares are calculated based on distance, time, traffic, terrain/route difficulty, and demand. All fares will be compliant with the regional transport regulations issued by the Motor Vehicles Division, Transport Department of Sikkim.
Payment Methods: You agree to pay all fares, convenience fees, and taxes associated with your ride via the available options in the app (e.g., UPI, Credit/Debit Cards, Digital Wallets, or Cash).
Cancellation Fees: You may be charged a cancellation fee if you cancel a ride after a driver has accepted it or if you fail to arrive at the pickup location within the designated time.
Taxes and Tolls: Goods and Services Tax (GST), state-border entry taxes (where applicable), parking fees, or permit fees required for specific restricted/protected tourist zones in Sikkim incurred during your trip will be added to your final invoice.
4. Passenger Conduct
You agree to treat drivers with respect. Verbal abuse, discrimination, physical altercations, or causing damage to the vehicle will result in immediate account termination.
You are responsible for the cost of repair or necessary cleaning/detailing of the Driver’s vehicle resulting from your misuse or misconduct.
PART B: MERO TAXI PARTNER (Driver Terms)
1. Driver Relationship with the Company
Independent Contractor: As a Mero Taxi Partner, you acknowledge that you are an independent contractor and commercial service provider. You are not an employee, agent, or partner of Obeevend Online. You retain the absolute right to accept, ignore, or decline ride requests.
Flexibility: You choose your own working hours and when to log onto or off the platform.
2. Driver Requirements and Documentation
To onboard and maintain an active status on the Mero Taxi Partner app within the state of Sikkim, you must provide and keep valid copies of:
A valid Indian Commercial Driving License (DL) with appropriate hill-driving endorsement if required.
Commercial Vehicle Registration Certificate (RC) registered with the Sikkim Transport Department.
Valid Contract Carriage Permit / Luxury Taxi Permit valid for operations in Sikkim.
Valid Commercial Vehicle Insurance policy.
Valid Pollution Under Control (PUC) certificate.
Identity proof (e.g., Sikkim Subject Certificate / Certificate of Identification, Aadhaar Card, PAN Card) for mandatory background verification.
3. Vehicle Compliance
You agree to maintain your vehicle in an excellent, safe, clean, and roadworthy condition that complies with the Motor Vehicles Act, 1988, and Sikkim Motor Vehicles Rules.
4. Platform Fees, Commissions, and Payouts
Service Fee: Obeevend Online charges a percentage-based commission (Platform/Service Fee) on every completed fare. This fee, along with applicable TDS under Section 194O of the Income Tax Act, will be deducted before payouts.
Payout Schedule: Your settlements will be processed and transferred to your linked Indian bank account via NEFT/IMPS or UPI according to the app's standard payout cycle.
5. Professional Code of Conduct
You must strictly comply with all traffic laws, speed limits, mountainous driving safety regulations, and regional transport rules.
Driving under the influence of alcohol or drugs, reckless driving on hilly terrain, off-app fare solicitation, or harassment of passengers will result in immediate, permanent deactivation from the platform and potential legal action under Indian law.
PART C: GENERAL TERMS (Applicable to Both)
1. Privacy Policy & Data Protection
Your use of the apps is governed by our Privacy Policy, which is compliant with the Information Technology Act, 2000 and applicable data protection rules, explaining how we collect, process, and safeguard location data and personal metrics.
2. Intellectual Property
All software, code, UI/UX design, source materials, trademarks, and logos associated with Mero Taxi and Mero Taxi Partner are the exclusive property of Obeevend Online. You are granted a limited, non-exclusive, non-transferable license to use the app solely for its intended purpose.
3. Limitation of Liability
Important Note: To the maximum extent permitted by applicable Indian law, Obeevend Online shall not be liable for any indirect, incidental, special, or consequential damages, including personal injury, property damage, loss of data, or criminal acts committed by third parties during a trip arranged via the platform. The platform is provided on an "as-is" and "as-available" basis.
4. Modifications to the Terms
We reserve the right to modify these Terms at any time. We will notify users of changes by updating the terms within the app or via email. Continued use of the platform after updates signifies your explicit acceptance of the revised Terms.
5. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes, controversies, or claims arising out of or relating to these terms shall be subject to the exclusive jurisdiction of the competent courts located in Geyzing (Gyalshing), West Sikkim.
